With the conivance of Ipswich Borough Council it is being developed and appartments are being sold to young couples at astronomical prices only to lose the value overnight. The biggest problem is the buyers are not being told there is a twin lane road way between them and the waters edge and those on lower floors will not see anything because of the stuff being stored on /&gt;The notice in the Star says the one way system is suspended.&lt;br /&gt;The notice is also on the lamp post on the dock.&lt;br /&gt;All along  the docks still are arrows denoting one way still.&lt;br /&gt;This is a month after the one way system was suspended.&lt;br /&gt;There is only a single carriage way for traffic going in two&lt;br /&gt;directions now and the confrontations are &amp;amp; Let Live Pub entrance on&lt;br /&gt;Wherstead Road. Or we could walk along the river&lt;br /&gt;to Bourne Bridge. This is a Public Right of Way as&lt;br /&gt;can be observed from the fact there was a public&lt;br /&gt;swimming baths here in living memory. The Public Right&lt;br /&gt;of Way on foot must not be blocked though and&lt;br /&gt;that is what is happening here. I feel sorry for&lt;br /&gt;the folks who bought an appartment here. The Act makes&lt;br /&gt;it plain a 30 foot wide road goes all around the dock and the New&lt;br /&gt;Cut has a 40 foot wide road each side. It is plain these are roads&lt;br /&gt;to be used by the public without restriction or obstruction. It is&lt;br /&gt;also stated the wharfs and quays are only to be used for unloading&lt;br /&gt;and loading goods. The timber stored by Anglo Norden is being&lt;br /&gt;stored unlawfully. The various gates at points around the dock&lt;br /&gt;and on the New Cut are also unlawful obstructions of the road.&lt;br /&gt;This is in effect a Public Nuisance under Common Law and it is&lt;br /&gt;possible to have folks taken before a Magistrates Court for this&lt;br /&gt;offence.  The Act quoted above is a repeat of the original 1837 Act&lt;br /&gt;which was the first Act. Not&lt;br /&gt;likely. I refused a caution and I have now been back to the cop&lt;br /&gt;shop twice, the latest being Monday 24-9-07 and still the CPS&lt;br /&gt;will not charge me. My solicitor offered to write to the CPS and&lt;br /&gt;try to get the charges dropped. No way. The body responsible for ensuring this is&lt;br /&gt;Associated British Ports who are the Port Operators.&lt;br /&gt;The body responsible for policing this as the Highway&lt;br /&gt;Authority is Ipswich Borough Council as they have an&lt;br /&gt;agency agreement with Suffolk County Council.&lt;br /&gt;IBC have an arrangement with ABP whereby they&lt;br /&gt;lease the very areas they are supposed to enforce the&lt;br /&gt;law. This storing of timber is unlawful as the Ipswich&lt;br /&gt;Dock Acts require a 30 foot space between the waters&lt;br /&gt;edge and the nearest obstruction to free air (think&lt;br /&gt;saling barges) and excludes any storage or building.&lt;br /&gt;The 30 foot space is required all around the dock and&lt;br /&gt;a space of 40 foot both sides of the New Cut. By law&lt;br /&gt;ABP are responsible for all maintenance of these&lt;br /&gt;roads but IBC is spending our money placing street&lt;br /&gt;furniture around the dock and New Cut. Anglo Norden&lt;br /&gt;should be required by IBC to remove the timber and&lt;br /&gt;ABP should be required by IBC to keep the roads clear.&lt;br /&gt;I contact the Health and Safety Executive whenever I&lt;br /&gt;see kids climbing on the timber. Go to look here;&lt;br /&gt;&lt;a href="http://www.hse.gov.uk/notices"&gt;http://www.hse.gov.uk/notices&lt;/a&gt; search geographical,&lt;br /&gt;then Ipswich and you will see Anglo Norden have a few&lt;br /&gt;reports against them. The 1913 Act provides for the New Cut to be&lt;br /&gt;'stopped up' but only with the consent of the Council and the&lt;br /&gt;erection of the gate. The council refused permission and the&lt;br /&gt;war intervened so the gate was not erected and thus the New&lt;br /&gt;Cut was not 'stopped up'. However there was then the 1918&lt;br /&gt;Act which neatly side stepped the need for permission from&lt;br /&gt;the Council but still depended upon the gate being erected&lt;br /&gt;and I cannot find any evidence this happened.
